Patient Safety Procedures

Telemynd provides and follows procedures to prioritize patient safety which is of paramount importance in healthcare, and it is especially crucial in telebehavioral health, where patients receive care remotely.

Patients safety is a main priority in the delivery of telehealth behavioral health care. Patients should expect Telemynd will take all measures possible to provide the highest quality of care in a safe and productive manner. This policy outlines procedures to ensure patients such care. receiving care via telebehavioral health are safe and receiving high-quality care.

  • Patients must provide informed consent before receiving care via telebehavioral health. This includes informing patients about the potential risks and benefits of telebehavioral health and obtaining their consent to participate in this mode of care.   • The healthcare provider must verify and note in the session documentation the identity and location of the patient receiving care via telebehavioral health to ensure that the right patient receives the correct treatment. Patients will be asked to provide their name and date of birth at the start of the telebehavioral health session.

  • Patients must have access to reliable and secure internet service, a device with a camera and microphone, and any software or apps required for the telebehavioral health session. Suggestions for Optimal Connectivity are provided to patients in the Telebehavioral Health Consent Form. The healthcare provider will confirm that the patient's technical setup is sufficient before the start of the telebehavioral health session.

  • Patients must receive care in a private and secure location to maintain confidentiality. The healthcare provider will ensure that their clinical setting is free of distractions and interruptions that may interfere with patient care. Providers are expected to follow session setting guidelines identified in the Standard Operating Procedures (SOP)

  • Patients will be informed about emergency procedures in case of technical difficulties, including a loss of connection or power outage. The healthcare provider will provide patients with contact information for emergency services and inform them of the steps to follow in case of a medical or mental health emergency.

  • Providers must document and sign the telebehavioral health session note and include it in the patient's medical record. The healthcare provider will as needed follow up with the patient after the telebehavioral health session to ensure continuity of care and monitor treatment.

  • Providers must continually evaluate and improve the quality of care delivered via telebehavioral health. Provider will receive feedback from patients regarding their telebehavioral health experience to identify areas for improvement.

  • Violations of this policy or associated procedures may result in appropriate disciplinary measures in accordance with the Company Code of Conduct or as outlined in any procedures document related to this policy.

Client Rights Under HIPAA

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities to help you.

    • You can ask to see or get an electronic or paper copy of your medical record.

    • We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.

    • You can ask us to correct health information about you that you think is incorrect or incomplete.

    • We may say “no” to your request, but we’ll tell you why in writing within 60 days.

  • You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address.

    • You can ask us not to use or share certain health information for treatment, payment, or our operations.

    • We will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures. We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.

    • Complete the Request For Accounting Of Disclosures form and submit it to privacy@telemynd.com or the address listed on the form.

  • You can ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically.

    • If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.

    • We will confirm the person has this authority and can act for you before we take any action.

Your Choices

For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations described below, talk to us. Tell us what you want us to do, and we will follow your instructions.

Our Uses And Disclosures

How do we typically use or share your health information? We typically use/share your health information in the following ways.

  • We can use/share your health information with other professionals who are treating you.

  • We can use/share your health information to run our practice and to improve your care.

  • We can use/share your health information to bill and seek payment from health plans or other entities.

How else can we use or share your health information? We are allowed or required to share your information in other ways – usually in ways that contribute to the public good, such as public health and research.   • We can share health information about you for certain situations such as:

    • Reporting adverse reactions to medications

    • Reporting suspected abuse, neglect, or domestic violence

    • Preventing or reducing a serious threat to anyone’s health or safety

  • We are required by law to maintain the privacy and security of your protected health information.

Your Rights and Protections Against Surprise Medical Bills

When you get emergency care or get treated by an out-of-network provider at an in-network hospital or ambulatory surgical center, you are protected from surprise billing or balance billing.

  • When you see a doctor or other health care provider, you may owe certain out-of-pocket costs, such as a copayment, coinsurance, and/or a deductible. You may have other costs or have to pay the entire bill if you see a provider or visit a health care facility that isn’t in your health plan’s network.

    “Out-of-network” describes providers and facilities that haven’t signed a contract with your health plan. Out-of-network providers may be permitted to bill you for the difference between what your plan agreed to pay and the full amount charged for a service. This is called “balance billing.” This amount is likely more than in-network costs for the same service and might not count toward your annual out-of-pocket limit.

    “Surprise billing” is an unexpected balance bill. This can happen when you can’t control who is involved in your care—like when you have an emergency or when you schedule a visit at an in- network facility but are unexpectedly treated by an out-of-network provider.

  • For informational purposes only, a link to the federal Centers for Medicare and Medicaid Services (CMS) Open Payments web page is provided here. The federal Physician Payments Sunshine Act requires that detailed information about payment and other payments of value worth over ten dollars ($10) from manufacturers of drugs, medical devices, and biologics to physicians and teaching hospitals be made available to the public.

You Are Protected From Balance Billing For

  • If you have an emergency medical condition and get emergency services from an out-of-network provider or facility, the most the provider or facility may bill you is your plan’s in- network cost-sharing amount (such as copayments and coinsurance). You can’t be balance billed for these emergency services. This includes services you may get after you’re in stable condition, unless you give written consent and give up your protections not to be balanced billed for these post-stabilization services.

  • When you get services from an in-network hospital or ambulatory surgical center, certain providers there may be out-of-network. In these cases, the most those providers may bill you is your plan’s in-network cost-sharing amount. This applies to emergency medicine, anesthesia, pathology, radiology, laboratory, neonatology, assistant surgeon, hospitalist, or intensive services. These providers can’t balance bill you and may not ask you to give up your protections not to be balance billed.

    If you get other services at these in-network facilities, out-of-network providers can’t balance bill you, unless you give written consent and give up your protections.

    You’re never required to give up your protections from balance billing. You also aren’t required to get care out-of-network. You can choose a provider or facility in your plan’s network.

  • You are only responsible for paying your share of the cost (like the copayments, coinsurance, and deductibles that you would pay if the provider or facility was in-network). Your health plan will pay out-of-network providers and facilities directly.

    • Cover emergency services without requiring you to get approval for services in advance (prior authorization).

    • Cover emergency services by out-of-network providers.

    • Base what you owe the provider or facility (cost-sharing) on what it would pay an in-network provider or facility and show that amount in your explanation of benefits.

    • Count any amount you pay for emergency services or out-of-network services toward your deductible and out-of-pocket limit.
